How to file complaint before RERA Authority: Step by Step Guide*

Once you decide to file complaint against the builder for delay or change in the approved plan or defect in construction and so on and so forth.   Very first step would be to know the property where is situated as each state has its rules and regulations for the RERA issues.

For example if   property is in Karnataka then you can file complaint before the Karnataka RERA authority   and you can file complaint online using this link https://rera.karnataka.gov.in/and it directly take to the page of complaint filing  wherein on your right side corner you see the option of complaint  registration click on that then that it lead to Complaint  Form.

In order to fill the required details please keep details of problem which is facts and what remedies you want details like RERA registration No of the property if know otherwise you can search the same in the RERA website by Project name.

Once you open complaint form then need to fill all the fields which is mainly divided to three sections (i) Details of the Complainant, (ii) Details of the Respondent or Builder and (iii) Details of the Complaint.

In order to fill the required details please keep the below details handy

Details of the Complainant

Is the one who is filing complaint or buyer or purchaser of the property. Here you need Name and complete address of the person who is filling the complaint along with Mobile Number, Aadhar Numb and email ID. Also you need scanned copy of the Aadhar or passport. Only Aadhar or Passport is allowed not any other proof is accepted.

Details of the Respondent or Builder

Name of the Builder and full address of the builder is required which you take it from the Prospectus or Agreement along with email ID of the builder and mobile and telephone number where RERA Authority can communicate for the remedy. So make sure you provide the details clearly.

Here you also need to fill name of the project and whether that project is RERA registered or not

Details of the Complaint

Subject of the complaint: To be written like your problem in nutshell For example refund for Delay in Possession or compensation for the change in the deviation plan or compensation for the delayed possession. In my view it is better to write the subject which indicates your problem and what relief you need.

Facts of the Complaint: It is very crucial and vital part of the complaint. Make sure you write all details problem precise and clear. Like when booked the flat or booked the property especially the date and when you paid the advance the amount and how much paid the advance amount. Most importantly what the prospectus or Agreement states the date of delivery or building plan. What is problem what went wrong and for that what remedies you want to have like refund or compensation or refund with interest.

Relief Sought from the RERA:Here you need to what remedies you want in gist and system does not allow to write the elaborate details.

This part asks you whether you want any interim relief means any relief which you want to have during the period of complaint hearing like stop issuing the demand payment notes or repair on priority.

Lastly you need to attach supporting documents like prospectus or Agreement in case of Delayed possession or proof supports your problem need to be attached and you can attach more than one document as well.

Payment

You need to fee of Rs. 1000/- and that can be paid via NEFT or RTGS or For making online payment through Khajane II. Once you pay then you will get thew reference no that has to be added to the Complaint form before filling. Bank Details to transfer the money is available in the Complaint form itself. Keep the proof of the payment documents to attach.

Last section of the Complaint is Declarations stating Property is falling in the jurisdiction and no case is pending in this regard like consumer complaint or civil case and you are stating the correct facts.

Upon filling all the details and you need submit the complaint and immediately upon which will get acknowledge number of the complaint and confirmation of the receipt of the complaint. At the same email will be send to you with acknowledgement number of the complaint and please keep this number safe for the future reference. Once the complaint submitted successfully you get email again of the status.

Hence your email is main communication point in the complaint and be noted that during the process of scrutiny and hearing you can’t check the status of complaint online. So, keep eye on your email in this regard.
